The first step is to file the fiance petition. Need to show you physically met during the last two years, and that you are an American citizen. Also need to show that you are legally able to get married (i.e. no pending divorces for example). This takes about 6 months to get a decision. Once the petition is approved, the Adjudicating center will forward the file to the National Visa Center (NVC) to make sure the chosen consulate is correct. (In this case, your fianc would proceed through Ciudad Juarez). The NVC will them forward the file to the Consulate in Ciudad Juarez. The consulate will schedule an interview. At the interview, the official will decide the ineligibility grounds (criminal history, unlawful presence, how did he comes to the attention of the authority, any document fraud, etc) and whether your fianc is eligible for a waiver. (This depends: Was he ever illegally present in the US for more than 180 days after his 18th birthday? Was he in the US from age 1 to whatever age he was until his voluntary departure without ever leaving the US in between? If your fianc is eligible for a waiver, he will be permitted to schedule another interview to submit a waiver application. The waiver could be decided within 2 weeks to 18 months. Best to consult with an attorney before to make sure he qualifies to apply for the waiver.

You need to speak with a family law attorney in your area and probably also need to work with the US Department of State so you can arrange to get your daughter back. You may also want to talk with the local district attorney's office as they may have an idea about jurisdiction for your case. I assume you have reported this kidnapping to the police so they may also know the exact procedures. I am not sure of the exact procedures however.

If you marry your fiance and file a petition/applications package with the Immigration Service, he should be able to receive a work authorization and re-entry permit in a few months, and a green card after you prove to USCIS that your marriage is real. It does not matter that he overstayed his admission; if he was inspected at the border and admitted into the U.S., and has no significant criminal history, previous immigration violations, or other disqualifications, he should be able to become a lawful permanent resident.
