Can I apply for citizenship if they are questioning my mother's marriage to my step father?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
If USCIS is able to successfully revoke your mother's lawful permanent resident status due to marriage fraud, it may also affect your immigration status because you received it on the basis of your mother's marriage to your stepfather. However, there is a 5-year statute of limitation on actions for revocation of residency status if the status was received through the adjustment of status process.

Can my wife help me get a green card?

Yes, she can certainly start the process for you, by filing the I-130 Relative Petition. But, it will depend on your immigration filing background to see if you can file for the green card here in the US or if you will need to go to your home consulate and apply for the immigrant visa. You should get information regarding your exact entry to the US, and find out if anyone ever filed anything for your parents prior to April 30, 2001. Get this information and consult with an experienced immigration attorney.

My boyfriend is Guatemalan with no status in the USA, if we marry will he be deported?

Answered by attorney Samuel Patrick Ouya Maina (Unclaimed Profile)
Immigration lawyer at Law Offices of S. Ouya Maina
If you are a citizen you may petition for him once married. Whether he can stay depends on his manner of entry, length of stay in US, and criminal history if any. I suggest consulting with an attorney so you can discuss in detail.
