Hello Theresa. I am not sure I follow your story all the way. Were you processing your Immigrant Visa based on your marriage to a US citizen? Did the consulate give you an option to submit the missing papers? Once you violate ESTA by overstaying, you cannot use it again. You will only be barred for 3 years if you overstayed your 90 days by another 180 days.  You can contact me with further information at: harun@kvisalaw.com

If your father sponsors you, it could take several years and you could age out. Ask her to reconsider or consult with an attorney about the CSPA.
