I want to marry my fiance who is currently in El Salvador, should I marry him there or bring here?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
There are advantages and disadvantages to the options you mentioned, but perhaps more important is to address how your fiance would enter the U.S. to become married to you in this country. Since it would be his intention to become married to you and apply to become a Permanent Resident, he would not be eligible for a visitor's visa, which requires "nonimmigrant intent." There may be other options available, however: if, for example, he were to have an H-1B visa, he could enter the U.S. with that visa notwithstanding his intention to become married and remain permanently. It would be wise for you and your fiance to consult with an immigration attorney who, after learning all of the relevant information about you and your fiance, could advise you about eligibility, options and strategies.

Could I apply for citizenship and when?

Answered by attorney David Nabow Soloway
Immigration lawyer at Kennedy, Nalepa & Soloway, P.C.
Generally, a foreign national who has been a Lawful Permanent resident (has had a "Green Card") for five years may be eligible to apply to become a naturalized citizen (and even may file the application 90 days before the end of that 5-year period). There are many other details that also address eligibility for naturalization, and it would be wise to work with an immigration attorney who, after learning all of the relevant information about you, could advise about eligibility and represent you in the naturalization application process.

Can i exclude my fiance son off affidavit of support since he's not coming?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
As long as the American consular officer approves the K-1 visa, the decision of whether to bring a child or not is up to the petitioner and beneficiary.
