A better idea than to try to refile the case now or file it in the different state may be to hire a criminal attorney if you have not already done so since such an attorney may be able to resolve the issue in some other way than waiting two years for a court date. An appropriate evaluation of naturalization eligibility requires significantly more information than just knowing a potential applicant completed 12 months of probation. There really is no substitute for consulting with an immigration attorney who, after learning all of the relevant information and seeing the arrest/conviction disposition documents would be able to advise you about eligibility and, if you may be eligible, to offer legal representation in the often complex process of a successful naturalization application.
An appropriate evaluation of naturalization eligibility requires significantly more information than just knowing a potential applicant completed 12 months of probation.
