How long does it take if he entered with a visa but currently has a deportation status?

Your question requires an attorney consultation. It is not a simple question that can be answered on this type of forum. There are many factors that would need to be considered and evaluated. First of all, since we do not have all the facts, it is not really possible to answer with complete accuracy. What do you mean by "deportation status"? Is he currently in deportation/removal proceedings? Does he have an order of removal/deportation already? I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

You must first apply for legal residency, which you can do one year from the date that your asylum was a granted. Then after 5 years of receiving your green card, you can apply for citizenship. I suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your situation. He/she would then be in a better position to analyze your case and advise you of your options.

My husband has been here since 1999, what are the chances of him not having to leave the country to get legalized?

Justin Wang

I assume he entered the US illegally. I further assume you and the child are US citizens(or at least one of you are). Based on the above, he is eligible for cancellation of removal. He has to show extreme and unusual hardship to you or your child. Please consult with an experienced immigration lawyer.
