I migrated to USA after 1 year process, 6 months of living there my husband brought me back to Pakistan and left me here. Can I go back to US?

Answered by attorney Stephen Arnold Black

You may be able to file a VAWA application and remove the condition to get your permanent resident card. More facts are needed. Discuss with counsel anywhere in the USA about possible contingency fee representation.

My H1 COS got approved on 10/15 /2020 . I have L2 extension in progress. If my L2 is denied will I maintain my H1 status

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
The last action rule generally has to do with approvals and not denials. If you are already approved for a change of status on your H-1B, an L-2 denial should have no effect since you are already holding a valid legal status. What documents do I need to sponsor my mom?

Answered by attorney David H Nachman
Immigration lawyer at NPZ Law Group
You will first have to file a Petition for an Immigrant family member on Form I-130. Later, you can file for an Adjustment of Status in the U.S. on Form I-485 if the family member is in the U.S. (and in status). Alternatively, your family member may be able to process for the green card at the U.S. Consulate. Please note that the process for sponsoring a member of the family has many nuances and we encourage you to consider hiring a qualified immigration lawyer or attorney with regard to this matter. One particular nuance has to do with the planning or filing of the Affidavit of Support Form and package.
