Will my wife be banned from the US if she surrenders her green card?

default-avatar
Answered by attorney Marie Andree Michaud (Unclaimed Profile)
Immigration lawyer at Marie Michaud, Attorney At Law
Your wife could do one of two things: Become a US citizen before moving out. Some countries allow dual citizenship, so she could use the US passport to travel to the US and her native passport to enter her country. Or you wife could simply surrender her green card, explain the situation and request for a tourist visa. Good luck.

Can I adjust my status after I overstayed my visa?

Answered by attorney Louis M. Piscopo
Immigration lawyer at Law Offices of Louis M. Piscopo, APLC
You are a derivative beneficiary of the I-130 petition filed on behalf of your husband. Therefore, he does not need to separately petition you. When he is eligible to apply for his Green Card you can as well. I assume that petition was filed before April 30, 2001 and your husband is protected under 245(i). If so, you are as well.

Do i have to pay international student (F1 visa) tuition for a four year university if my i-485 is approved (Adjustment of Status)

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Generally speaking, an individual with a pending I-485 application is not considered to be a permanent resident with all the rights and privileges including in-state tuition payment. However, you can check with UCSD to determine whether it has a different policy. California appears to be a progressive state for immigrant rights.
