What happens to my petition when I turn 21?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
There are complicated rules protecting you after you turn 21 for the period of time that the I-130 was pending. This is called the Child Status Protection Act. Your case would need to be analyzed with the specific facts under this Act.

Unfortunately, USCIS has a huge backlog on EAD extensions. It will only entertain and expedite under the following circumstances: If you are a healthcare worker Who has a pending Employment Authorization Document (EAD) renewal application (Form I-765, Application for Employment Authorization); and Whose EAD expires within 30 days or less, or has already expired. USCIS may also consider an expedite request in your case if it meets one or more of the following criteria or circumstance: Severe financial loss to a company or person, provided that the need for urgent action is not the result of the petitioner’s or applicant’s failure to: Timely file the benefit request , or Timely respond to any requests for additional evidence; Emergencies and urgent humanitarian reasons. How long does it take for form i130 submitted with form i145 to be processed?

Answered by attorney Lynne Rogers Feldman
Immigration lawyer at Feldman Feldman Associates, PC
Depends on what are of the country you live in but most of these cases are being approved after an interview in 4 months or less. Receipt should come with 30 days, fingerprints shortly thereafter, work card (and travel permit if eligible) shortly thereafter, then interview notice. If you move it is critical to promptly report the address change online with an AR-11 and also call the customer Service number.
