Imigration 485 Pending

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
U.S.C.I.S. will generally hold an I-485 case in your situation until there is a disposition. You or your representative will have to keep U.S.C.I.S. informed of the status of your DUI case. I note that there is currently a movement in the immigration laws to consider DUI offenses more serious as seen in people being barred from The Deferred Action for Childhood Arrivals (DACA) program if they have DUIs. To be on the safe side, you or your lawyer may consider attempting to have the case dismissed or the charge changed to another ground. What paper work should a Chinese citizen Bring to the US To marry an American citizen

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Initially I must caution you that if you and your fiancé are planning for her to travel to the States on a visiting visa for the purpose of marriage, she might have a problem with a U.S.C.I.S. officer who may believe that she abused the visitor's visa. The proper course where the purpose of coming to the US is to marry is for you to file a fiancée visa petition with U.S.C.I.S. Documents that your fiancée should bring over are her notarial certificate of birth, dissolution decrees from all former unions, and birth papers of any children that she may have. She should of course have a valid passport. Those would be the general papers from overseas that U.S.C.I.S. requires.  Whether she requires any other papers for any other agency would depend on the requirements of those agencies.Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. What happens to my wife's visa if it already expired?

default-avatar
Answered by attorney Yahima Suarez (Unclaimed Profile)
Immigration lawyer at Hernandez & Suarez, PL
She will not have to travel to her country of origin to be able to apply for adjustment (residency). However, for the time that she is waiting for the visa to become available (3-5 years) since you are a US Resident, she will be illegal and immigration could start deportation proceedings against her during that time regardless of the visa petition outstanding for her. Once she files for residency and work permit, she will be safe until the residency is granted.
