Can my father in law who is a American citizen sponsor his grand kids who are canadian citizens to the USA

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
A relationship between grandfather and grandchildren is unfortunately not one that can lead to permanent resident sponsorship. Perhaps their grandfather would be satisfied with less, e.g. having the children stay with him during school breaks and the summer. That could be done just by you taking the children to the US on your passports since Canadians do not need visas to cross the border and if need be, explaining your purpose to CBP at the border. Due to the limitations of the Lawyers.com Forums, Alan Lee, Esq.'s (the "Firm") participation in responding to questions posted herein does not constitute legal advice, nor legal representation of the person or entity posting a question. Can my three kids be both American and Ecuadorian citizens?

Answered by attorney Doreen A. Emenike
Immigration lawyer at Law Offices of Doreen A Emenike
Hello, The best way to find out if your children can get Ecuadorian citizenship in addition to their U.S. citizenship is to contact the Ecuadorian consulate. At our law firm we have filed citizenship applications for people who do not want to give up their original nationality and the USCIS has not asked them to choose one. However some countries will ask you to revoke your original citizenship before you can become a citizen so it is a good idea to check with an Ecuadorian consular officer first. Good Luck. The information above is of a general nature and is not, nor is it intended to be legal advice. For specific legal advice about your situation, please speak to your immigration attorney.

S there anyway to get my child US citizenship without the fathers cooperation?

Brian D Lerner
Answered by attorney Brian D Lerner (Unclaimed Profile)
Immigration lawyer at Law Offices of Brian D. Lerner
*Derivative Citizenship* In some cases, people are U.S. Citizens and do not know it. In this case, it is possible for us to file what is known as a Derivative Citizenship Petition. It is a petition that if approved, will give proof of U.S. Citizenship. There is a significant amount of evidence that would be required for this type of petition, but if done properly, there is a reasonable chance of success. There are ways of obtaining records without his help.
