How long will it take to give the residence to my married son. He Lives in Lima , Peru. I am an American citizen.

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Unfortunately you would be sponsoring your married son under the F-3 category for married sons and daughters of US citizens. Currently the waiting time is approximately 12 years as the visa availability date for the month of June 2020 is only up to April 15, 2008 for all of the world except for natives of Mexico and the Philippines who must wait longer. If he wishes to immigrate faster, he should sek another route. Can my husband file the i1751 waiver before the divorce is final?

Answered by attorney Kevin L. Dixler
Immigration lawyer at Law Office of Kevin L. Dixler
You should consider whether it's best to file a self petition after the divorce is final. If you are divorced, a joint petition must be denied. You should consider hiring an experienced immigration attorney before the matter is complicated by immigration court.

Can I marry her directly with the help of this country’s DIVORCE certificate or I have to DIVORCE in US too, with my ex-wife?

Answered by attorney Richard Stephan Kolomejec (Unclaimed Profile)
Immigration lawyer at Richard S. Kolomejec
USCIS will recognize foreign divorces. So you can marry a US citizen without having to reapply for the divorce in the US. If done right, you should be able to get a green card in about 3 months.
