If I cancel my US consulate (mexico) appointment, can i go back to the US using automatic visa revalidation?

Answered by attorney Alan Lee
Immigration lawyer at Alan Lee Arthur Lee, Attorneys at Law
Automatic visa revalidation is available for those who have visas (even if expired) in the passport, are traveling to Mexico or Canada for 30 days or less, hold a valid passport and legal nonimmigrant status, and reenter the U. S. at a port of entry. It is not available in cases where individuals choose to interview for a visa beforehand and are rejected. So if you are planning to use automatic visa revalidation, you can cancel the U. S. Consulate appointment unless you plan it so that you attempt to reenter first on automatic visa revalidation and if there is trouble, go to an appointment at the U. S. Consulate to try to obtain the visa. I do note that in past years there were reports of Customs and Border Protection officers sometimes giving people using this device a difficult time upon entry. What forms do I need to file to marry a US citizen?

Answered by attorney M. Gabriela Ungo
Immigration lawyer at GC Ungo Immigration
I assume you are getting married to a US citizen and your question is which immigration forms you need to file to obtain a green card or residence status I'm the US? The answer depends a many factors, if you're eligible: are you physically present in the US or are you abroad? If you are in the US, were you inspected (entered with a visa) at port of entry?

How long will it take if I file I-130 and I-485 for my mother if she had a 5 year multiple visa for US?

Answered by attorney Phong Thanh Tran (Unclaimed Profile)
Immigration lawyer at Law Office of Pho Ethan Tran, PLLC
USCIS is currently taking about 4-6 months to adjudicate an I-485 application that is based on an I-130 petition filed by a U.S. citizen son or daughter. Under U.S. immigration law, your mother is considered an immediate relative of a U.S. citizen. Thus, she can apply for adjustment of status at anytime as long as she entered the U.S. with inspection, even after her visa or authorized stay expires.
