He can apply for his green card after he gets married. The green card process will only take about 3 months from start to finish. No penalty and he doesn't need to leave the US.

No. You must legally terminate your marriage before you can marry your USC fiancee. It doesn't matter where you get divorced as long as the marriage is terminated. Thus, you can terminate your marriage in the Philippines or here in the US.
