Can I apply for a different visa if I am waiting for another visa?

Reza Athari
Answered by attorney Reza Athari (Unclaimed Profile)
Immigration lawyer at Reza Athari & Associates, PLLC
Yes, you will have to start the I-130 process. Your brother or sister may be co-sponsor. You may stay outside US but the US consulate will want you to come and resume your residency in the US a few months before her interview. I suggest that you hire an immigration attorney to navigate you through the process.

Answered by attorney Kenneth G. Wincorn

It is best for him to get citizenship to speed up the process. He can apply for you once you are married but the approval is much faster if he becomes a citizen.

It is the opportunity to apply for a green card. You have to be a permanent resident first. After the applicable waiting period, she can apply for citizenship in her own right.
