Do I still have to go to Mexico when I apply for a residency or can it all be done here without having to leave the country?

Even though you were granted a deferred action relief, if you leave the U.S., you will not be able to come back for at least 10 years - unless the Attorney General would grant you a waiver of inadmissibility. This waiver is not given easily; so you should not risk leaving the U.S. without it being absolutely necessary. Speak with an immigration attorney to see if you might apply for the waiver while you are in the U.S.

How can I file a petition for my fiance?

Answered by attorney Harun Kazmi
Immigration lawyer at Kazmi & Sakata
Hello. The fastest way would be if you were together in the US and decide to marry here. However, he cannot come as a tourist with that preconceived intent. Therefore, the other option would be to file a K1/fiance visa now. This can take about 6 months to process. In addition, if you have Residency status in the Philippines, you can marry there and file directly at the consulate as well.

If he entered the country illegally, he will have to leave the country and go through a consulate. He will have to file a hardship waiver in order to get back into the country.
