No income will not affect you becoming a citizen. But, why would you have not filed taxes? If you are married, you should be filing jointly with your husband. One of you must be making money. You could have a problem, but more information is necessary. You should not file for naturalization before speaking to an immigration lawyer.

You will be assigned a higher potential fraud designation but I have successfully handled many of these type of cases over the years and they are approvable; the burden is on you to show the marriage is in good faith so document, document, document - all ties to each other, tax returns, debts, assets, bills, bank accounts, health insurance, car title, pictures together with family and friends, trips together, whatever you have. It is a little difficult to answer your question because it is not clear whether you just want her to live in the US or want her to become a US citizen.  It is also not clear how she lived in the US for over 10 years.  If she was here as a permanent resident and still has her green card, then I would suggest that is the best way for her to retain her right to live here.  If she wants to naturalize and cannot take the test in English, she can take the test in her native language if she is over 55 years old and is a permanent resident for over 15 years.  Please feel free to call if you have any questions.  Jan Joseph Bejar, Esq., (619) 291-1112
