If all three of us are on the deed of the house by law, can her power of attorney sell the house without all three of us agreeing to sell it?

Answered by attorney Dara J. Goldsmith
Estate Planning lawyer at Goldsmith & Guymon, P.C.
The power of attorney died with your grandmother. However, the Executor can probably sell the property. Sales are sometimes necessary to pay debts. I urge you to contact an attorney where your grandmother lived to have a consultation by phone to address your situation and next steps.

You need to amend your will or trust to specify what you want to go to your grandson, otherwise it is at your son's discretion.
