You are strongly advised to obtain the services of a probate/estate planning attorney, to answer your many questions; be careful about doing an irrevocable living trust, because once established, then it takes a court order to revoke or amend should you change your mind about some provision. A revocable trust is the better way to go.

If the DPOA gives you the authority to transfer property, it is technically legal. However, if you have siblings or he has a wife, etc., there will be a long hard look at the transaction. Why can't dad do it himself if he is competent. If he isn't competent, then his instructions don't really mean anything, do they?

If mom put my brother on the deed to her property does this give his wife any claim to the property in the event of mom's death or a divorce?

Depends on how she did it. If she merely added him as a joint tenant on the property, and he paid nothing for this, then it is his separate property.
