Would a Statutory Durable POA override a spouse?

I think the POA overrides the prior spouse, even if the prior marriage is ruled valid. I do believe, at least in my state, PA, a married person can designate whoever he or she wants as agent in a POA notwithstanding blood or marriage. WHere blood or marriage come in is with the will, for inheritance. Make sure he has a will, so in the event the last wife would contest the estate and the prior marriage be ruled in her favor she wont get the bulk of the estate. See a local TX lawyer for more specific details regarding TX law.

In Texas there are a couple of questions that need to be asked. Was the house community or separate property? Next are there children outside this marriage, such as a previous marriage? Since you say it is your mother and father, I will answer as if your sisters are also the product of this marriage. If the house is community property, it belongs to your mother. If the house was your father's separate property, it belongs to you children. She however, has the right to live in it all of her life. Whether her stay in the nursing home is sufficient to remove that right, is a whole different question.

Your property will pass by your will, if you have one, or the intestacy statute if you have no will. If you have no will, then you have to look at how you acquired the property. Was it separate or community? Separate property and community property are divided differently.
