When you become an administrator of an estate, how do you know your duties?

default-avatar
Answered by attorney Candace Kay Ladley (Unclaimed Profile)
Estate Planning lawyer at Candace K. Ladley, Attorney at Law
Normally your attorney will provide you with instructions on your duties and liabilities as an executor or administrator. If you still have concerns you should contact your attorney directly and discuss them with him or her. In California, the executor or administrator receives the same fees as the attorney, which is a percentage of the gross estate on a sliding scale. If you perform extraordinary duties, such as running or selling a business or residence, you can have your attorney petition the court for extraordinary fees which are usually based on your knowledge, education and experience. Discuss this with your attorney In Washington state, the executor or administrator is entitled to reasonable fees which are based on your knowledge, education and experience and difficulty in handling the estate. Discuss this with your attorney.

What is the probate process after a parent's death?

default-avatar
Answered by attorney Jeffrey R. Gottlieb (Unclaimed Profile)
Estate Planning lawyer at Law Offices of Robert H. Glorch
It's not automatic. To set the probate process in motion, someone (e.g. the executor in the will or another family member) has to petition the court to be appointed. Normally the person who wants to file the petition will hire a probate attorney to represent them. The question of where the probate estate should be opened is an issue of fact. You mentioned that he was temporarily living in another state. Probate should be opened in the state where the decedent last had his permanent residence. So for example, if I live in Illinois, but happen to die while on vacation on Florida, my estate should be in Illinois even though I died in Florida. It's a little trickier if you're father was actually stayed in another state for a period of months, or years. It's really a question of fact and should come back to where he intended to live on a permanent basis. But this issue can be the subject of dispute at times, in part because state inheritances laws can differ.

Can an outside child have stake in my Dad's property?

default-avatar
Answered by attorney Susan Goodkind Wideman (Unclaimed Profile)
Estate Planning lawyer at The Wideman Law Center, P.C.
Once father has died, if the property has to go through Probate (wills usually require Probate) he could try to make a claim on the property in the Probate Court, but he may not be successful.
