am named as contingent beneficiary and my step mom is executor. she wants me to sign a waiver of notice ? what does that mean for me?

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
It means two things.  First, you agree that you do not need to know the date of the hearing and be present.  Second, it means that you agree that your stepmother should be able to administer your father's estate free of court supervision.  This means that she does need to submit an inventory but does not need the court's permission to sell, for example, your father's car and does not need to provide an accounting to the court.  A beneficiary may nonetheless request an accountign 15 months after the executor is appointed. Are you sure that a Will is being probated?  Ordinarily, beneficiaries are notified after, not before, a Will is admitted to probate.  In an intestacy, heirs are asked to sign a distributee's waiver of notice and consent to application for independent administration before the hearing.

Is it customary that beneficiary decendancy go to direct heirs, by bloodline, of a trust when an heir dies?

Answered by attorney Edward L. Armstrong (Unclaimed Profile)
Estate Planning lawyer at Edward L. Armstrong, P.C.
It is not clear if the deceased's spouse was alive at his death. If she was alive at his death and she was omitted from the trust for whatever reason she would have the right to elect to take against the estate but the election must be made rapidly. If an estate was opened in the probate division of the circuit court (if the trust was contained in a will this would be the case). That election would have to be made within six months of the grant of Letters Testamentary or Letters of Administration. If the spouse has since died at the very least an estate should be opened for her. The heirs of the wife need to hire counsel to protect their rights.

Do I have any rights to my step dad's estate if I have been taking care of him?

James Brian Thomas
Answered by attorney James Brian Thomas (Unclaimed Profile)
Estate Planning lawyer at Burdette & Rice, PLLC
Claims against an estate for family caregivers can be challenging to deal with, since there is rarely any sort of a formal agreement like you might find in any other creditor/debtor relationship. However, you may certainly have such a claim for reimbursement and you should seek the aid of a local probate attorney to assist you. With regard to the division of your step-father's estate, and whether or not you might be entitled to some part of it as an heir, the answer depends upon several facts that you don't really develop through your question. Again, a probate attorney can help you begin to sort through the issues and it sounds like there are many of them.
