When you become an administrator of an estate, how do you know your duties?

The judge will not sent you instructions; if you are represented by lawyer in the probate, he or she will give you instructions and when the probate is ready to close, you will be entitled to fees. The fees are statutory and are a percentage of a graduated scale, the amount depends upon the dollar amount in the probate estate.

Do I need a will if I only have non-probate property that will go to my son and only beneficiary? Wish to avoid probate. No real property involved.

Answered by attorney Terry Lynn Garrett
Estate Planning lawyer at The Garrett Law Firm, PLLC
If all you have is non-probate property, all you have is property which does not pass under a Will.  In that circumstance, you do not need a Will.

Does this make the home community property given he added my name to the deed?

Answered by attorney David L. Leon
Estate Planning lawyer at David L. Leon, P.C.
You need to look at the title of the house. If you're on the title, then you have an ownership interest. If you're not, then you may have only an equitable interest if you divorce. If you want to be sure, hire a title company or real estate lawyer to prepare a deed from him to both you and him.
