If your Dad had a will and it named you as the Executor then the court will likely honor those wishes and you will just have to hire local counsel and realtors etc.

If you do a valid Estate Plan you can leave your estate to anyone you wish. You may also not to leave anything to certain children. If the you will be disinheriting certain children it is important to avoid both probate (no Living Trust) and intestate succession (no Will).

An executor can be removed for cause by filing a motion in the probate court detailing what the executor has done to deserve to be removed. The executor will be able to respond and a hearing will be held to review any evidence presented. If wrongdoing is proved, the judge can remove the executor.
