Valuation begins when the trustor (creator of the trust) becomes incapacitated and the successor trustee takes over. Family will probably have some claims against trustee if he used trust monies and POA for his own benefit.

It sounds like she already signed saying she was going to split it with you. Make sure that is clear. Other than that, the only thing you can do is contest when your mother is gone.

You have a right to be kept reasonably informed, and also the right to periodic accountings. By the way, your brother might be executor of the estate or [successor] trustee of the trust, but executor of the trust does not exist. The rules for the two are different. Hire a lawyer.
