First of all wills in CA are not notarized. Second, $800 is high for a simple will. Your mother can create a new will, mention the facts of the old will in the new one, specifically revoke the old one in the new one, and leave the will in a safe deposit box or with the attorney who drafted it for safekeeping.

It depends on whether or not the executor was designated as an "independent" executor in the will. If he was, then he can sell the property on his own terms, even if someone else comes up with a better offer. You can file an objection with the court, stating that the price at which the executor proposes to sell is too low. That would mean hiring an attorney to represent you, and paying fees and costs. That route would only be worth it if the price difference is big enough.

Your answer needs to see an estate planning attorney and make a modification to her will. If it is not done her present will be placed into effect. Certainly, your issues with the Internal Revenue Service may be a factor which she wishes to take into account.
