As executor you have the responsibility to secure all possessions of the estate.. including all your mom's belongings.. Your sister should not be interfering in that process.. so if she does.. you have several choices..File a motion to have her thrown out of the house at least temporarily because she is interfering with administration of the estate Actually worst case you can come in an move everything out of the house into storage assuming it is all your mom's possessions (at estates expense) until you have the time to review it and sort it.

Not likely. If there is a contract in place, there is not much that you can do. If there is a lawyer representing the PR, you can have the lawyer review the situation. The heirs normally do not need notice or consent of a sale of the property. It is unfortunate that this happened, but there may be little you can do about it.

In California, these gifts are called specific bequests. Yes, it is common practice to put them in a will, and adds assurance your wishes will be followed. Be sure to indicate for gifts to residuary beneficiaries whether the gift counts toward their distributive share or is in addition to it. In close families with no conflict, it can be done informally, by simply leaving a list with the child in charge. But unless you are sure of it, the safer practice is to put it in the will.
