I don't know if it is illegal. If the one collecting the rent is paying expenses of the property from the other, it would be fair.

You do not automatically have a life estate in the house. If your husband has a will, then the terms of the will dictate what happens to the house. The only exception to this is whether you have a community property interest in the property, due to contributions of community income to pay the mortgage, maintain the property, pay the taxes and insurance, et cetera. You will be entitled to a return of your community property instance. If your husband dies without a will, you are entitled to your community property interest, plus a share of your husband's separate property. The other shares will pass to your husband's issue. You and your husband should be meeting with an estate planning attorney, so that you are both clear as to what happens to your property when one or both of you pass away.
