What can be done if a friend of 50 years is dying with a few houses but has neither will nor family?

In and out of consciousness could pose a fairly substantial hurdle in terms of his capacity to execute a Will, but it's impossible for anyone to answer on a Q&A forum. If he dies with property in his name without a Will, his estate will pass to his legal heirs.? Even if he has no spouse, children, parents, siblings or nieces/nephews does he have cousins? Any living descendants of his grandparents? They could be heirs.

What can I do if I'm being ask to sell my house and move into my mother's house?

Randy M Lish
Answered by attorney Randy M Lish (Unclaimed Profile)
Estate Planning lawyer at Randy M. Lish, Attorney at Law
If the house is titled in your name, only a mortgage holder can force you to move, and then only if you are behind in payments, and they are foreclosinig. No one else has a legal right to force you to do anything. If everything is held pursuant to a conservatorship, then everything changes. If there is a conservatorship involved, please contact me.

As the executor of estate, must I pay my niece?

default-avatar
Answered by attorney James T Weiner (Unclaimed Profile)
Estate Planning lawyer at James T. Weiner, P.C.
Has the estate been formally closed? Did you notify the Court that she refused the money? and get the court's blessing on keeping the funds? Was it over 4 years since the estate was closed? (there may be a statute of limitation of 3 years if you were deemed to have converted the funds after you are discharged as the executor which I believe is 1 year after the estate was closed) Please contact an attorney if you have any more questions..
