What are my rights to a share that was given to me by one of my mother's heirs?

Answered by attorney Jayne L. Sebby (Unclaimed Profile)
Estate Planning lawyer at Jayne L. Sebby
Your situation depends on the condition of the estate that the executor is trying to close. An executor's first obligation is to pay off all the debts owed by the estate. If there aren't enough liquid assets (cash, CDs, etc.), the other assets, including real estate, will need to be sold to come up with the money. So that may be why the executor is asking you to move out. If that's not the issue, it may be that the other heirs who own 2/3 interest in the property want to sell it and receive cash instead. If that's the case, you can offer to buy their interest and stay in the house.

Who can I hold liable after my father passed away in December, I went by his house in February and items are missing?

Answered by attorney James P Frederick (Unclaimed Profile)

There is not enough information to give you a confident answer. There will be issues of evidence and proof, no matter what happens. Whether the company that secured the house has the items is also a question. Since there is a mortgage on the property, if you have any interest in the home or the contents, you will need to continue to make payments and/or file a probate estate in order to become Personal Representative. Otherwise, you have no right to pursue any action at all. Only the PR can sue for an estate.

Can I force the sale of a jointly owned property listed as a LLC?

Answered by attorney Richard Eldon Blasco (Unclaimed Profile)
Estate Planning lawyer at Richard E. Blasco, Inc.
You have a complex legal problem and need to see a real estate attorney. Sell your interest, or buy out your uncle. The easiest way to resolve a valuation dispute is to offer to buy or sell the 50% interest. If you acquire 100% of the property, you can then sell it. Note that if the LLC's rights have been suspended, the LLC cannot sell the property without its rights being reinstated. You have tax issues with the Franchise Tax Board, and, if you acquire the property, you need to coordinate the sale with paying the FTB.
