If you use inherited funds to pay off a mortgage of your sister, you, as the donor, must pay gift tax beyond the exemption allowed every year. You could consider paying down your sister's mortgage every year by the exemption amount, and therefore avoid the gift tax - although it may take some years to pay it all off.

Your husband needs to consult with his own probate attorney. The will should have been filed, so a copy should be available. The probate attorney will need to look at the will. If the executor is not fulfilling his duties properly, that might be a basis for asking the court to change executors. There may be a basis for forcing a sale of the property, but if the executor was waiting for prices to increase, that may have been a legitimate decision.

He can't evict you, but he can make you pay rent for living in the home. If you don't pay the rent, then he can have you evicted. However, you should be able to count what you have paid for taxes and upkeep toward the rent, so be sure to keep careful records.
