Not good at all. DUI cases are prosecuted very hard and dismissals are very rare. He may have to try the case if he is innocent.

What would happen if I took a breathalyzer test but the test came back with no results?

You already know what would happen: (1) you would be charged with a refusal, because the officer alleges that you played around in blowing rather than just blowing; and (2) the officer would arrest you for DUI. When you get to court, the prosecutor and judge, but maybe not the jury, will believe the officer when he testifies that you were pretending to blow, and that is why there was no reading on the breath test.

Yes.? If the keys are in the ignition and you are behind the wheel, the court can find that you were in control of the vehicle and thus driving.
