If the car is being held for investigation, at some point they will notify you (or you could have your lawyer contact them) about getting the car back. At that time they could issue you a summons for DUI or I suppose even arrest you for DUI.  I strongly suggest talking to a lawyer NOW so the case gets off on the right foot from the very beginning.

You could seek a new trial, but that requires a judicial determination. I don't know if a new trial would be allowed based on what you present here. You would need to speak with an attorney and provide much more detail. There must be either judicial error or ineffective assistance of counsel or some other reason to get a new trial. Simply disagreeing with the outcome will not be enough. Good luck.

Not good at all. DUI cases are prosecuted very hard and dismissals are very rare. He may have to try the case if he is innocent.
