Sure, you can fight it. They must prove there is a "detectable amount" of alcohol in your system while you were driving to be DUI (a DWI for minors). They have to ascertain that somehow.

The degree to which any attorney can help you depends on several factors. As an initial matter, the prosecutors first have to be able to prove you were guilty of the offenses. If not, a good lawyer might be able to get one or more of the charges dismissed. If they can prove all three, then it becomes a matter of negotating with the State, and discussing the risks associated with any potential proposed resolution, with you. Why is the DWI that was dismissed on record and can the court, use that against me?

That would depend on how or why the DUI was dismissed. If a Deferred Prosecution then the DUI can indeed be used against you later if you get another DUI within 7 years.
