Will I get charged if my friend got a DUI while driving my car?

Answered by attorney Terry Alan Nelson (Unclaimed Profile)

No, you won't have any charges or get sued unless he crashed the car. It would be normal for the car to be impounded by police, forcing the registered owner to go pay to get it back.

Is jail time mandatory in California for a second DUI?

Mandatory? No, but possible. While this isn't a 'capital case', you certainly face fines and potential jail, so handle it right. If you don't know how to represent yourself effectively against an experienced prosecutor intending to convict, then hire an attorney who does, who will try to get a dismissal, charge reduction, diversion, programs, or other decent outcome through motions, plea bargain, or take it to trial if appropriate.

Can I fire my attorney if I don't feel he is qualified?

You have an absolute right to relieve your attorney at any point. If you're not confident, you may want to have a serious discussion with them and evaluate from there. There's no way for us to guess, just based on your blood alcohol level, as to whether or not your case is one that will get a wet or a dry offer. That can only be assessed after a thorough review of the case.
