Whether a DUI is a felony or misdemeanor depends on if you have prior DUIs and if anyone was injured. The minor in possession will not impact that. But you could have additional charges for driving on a suspended license and a probation violation if you are on probation for the MIP. Get an attorney, especially since you want to minimize how this will impact your future.

No, the punishment will not be greater simply because there was a passenger in the vehicle. If someone, on the other hand, was injured, then you would be facing a felony charge. Merely having a passenger in the car is not an issue unless the passenger was a minor child. In that case, you would be facing "child endangerment" charges.
