If your case is in California (the 3rd degree driving while intoxicated is confusing) you may be able to get house arrest, in-patient rehabilitation, out-patient rehabilitation or some other alternative to actual jail. The manner with which one is allowed to receive jail credits is determined by the Judge and/or the Department of Corrections for the county where you are being prosecuted. If the county offers house arrest and the Judge permits it you can do it, if not, you have no "right" to house arrest, or any other sentencing alternative. A DUI attorney in your area can help you determine what sentencing alternatives may be available, they may even be able to help you avoid conviction.

Although an officer should read you your Miranda rights when you are arrested, it is not absolutely necessary as long as you are not questioned about the crime for which you were arrested or were detained during the questioning. Miranda only acts to suppress any statements you gave the police after you are arrested or detained. It does not invalidate an arrest.
