Can a judge add additional sentencing to a case that had been plead?

Richard Keith Oliver
Answered by attorney Richard Keith Oliver (Unclaimed Profile)
DUI/DWI lawyer at The Law Office of Rick Oliver
Yes. It's not additional sentencing in the way you are thinking. He's adding a condition to your request for an occupational license. And, as it appears your suspension is due to the convictions, the judge may be required by statute to impose the interlock as a condition of the occupational.

How can I have my DUI drop to a reckless opp.?

Answered by attorney James Kristian Falk (Unclaimed Profile)
DUI/DWI lawyer at The Falk Law Firm, LLC
I am concerned about your chances of getting these charges reduced. It may depend upon what is on the tape of the field sobriety tests. Based on the content of the tape your lawyer may be able to have the results of the BAC test suppressed.

Can an blood test show more alcohol than a breathalyzer test?

Mark Corwin Bruce
Answered by attorney Mark Corwin Bruce (Unclaimed Profile)
DUI/DWI lawyer at Law Office M. C. Bruce
This is called the "rising blood alcohol defense". If you drank recent before the stop, your blood is still processing the alcohol. So at the time of driving, you were at an .06. But by the time they took you to have blood drawn, it rose. This is a defense, believe it or not. Get a lawyer to have it run for you. Don't do this on your own.
