Can a deputy sheriff pull you over on the freeway? Yes. They have peace officer status anywhere in the state. The freeway isn't solely the CHP's jurisdiction. They don't necessarily have to show you the result of the breathalyzer and may have repeated it to get two results that were in agreement. If this is the case, it's worth it to have an attorney review your case. There may be calibration or procedural errors, invalidating the results of the test. Regarding the reason for the stop: a purely anonymous tip, there may not be sufficient evidence to justify a stop unless they corroborated the information (i.e. Saw "bad driving" themselves). If the original stop was invalid, ALL evidence is subject to being suppressed and excluded from court. Keep in mind that you also have only 10 days from the date of your arrest to challenge the DMV's license suspension.

Yes, you need an attorney. Although not having taken a breath test does help your cause, the fact that you were arrested and detained overnight, leads me to believe that your actions on that night may constitute probable cause of arrest you and may be enough to convict you if testified to by the police.

DUI cases involve two processes, one through the criminal court and one through the DMV Administrative Per Se Hearing (APS). In order to not have any suspension you must win the APS hearing and not be convicted of a DUI in criminal court OR if you lose the APS hearing, you can unwind the action by a full acquittal or NOT GUILTY at trial. After trial you or your attorney must submit a certified copy of the verdict to the DMV to unwind the APS action.
