Why would my brother not get out on bond for a DUI?

Answered by attorney Francis John Cowhig (Unclaimed Profile)
DUI/DWI lawyer at Francis John Cowhig
Your brother may have some type of hold on him that prevents him from being bailed out. A call to the jail or police station may be helpful in finding out why he cannot be bailed out. A better option is hire an attorney to represent him (since he will need one anyway) and have the attorney find out why bail has not been set. The police or jailer will give an attorney more information than they may give you.

What is the statute of limitation in California to file a DUI charge?

Hudson Thomas Bair

DUI/DWI lawyer at Kapsack & Bair, LLP
Assuming no one was hurt and no grounds are presented for a felony prosecution, the prosecutor has one year from the date of the incident to file charges. It sounds like you will not be prosecuted for this accident. You may have licensing complications at the DMV, a DUI lawyer can help you if you do have licensing issues.

Can the DUI charge be reduced to a reckless again?

Yes, the charges are totally independent of each other. Get a good lawyer and good luck. Not a likely result but possible.
