If I pay my fines off and comply with all of my requirements by the judge, am I off probation or do I have to apply for an early termination?

You are on probation for 12 months unless you ask the judge for early termination of probation. You can hire an attorney to do this for you, or you can go to court and ask the judge yourself. You must prove that you have done everything the judge required you to do, plus you can't get early termination of probation unless you have completed at least half of the total probation time. You should also call the court clerk to confirm that this judge will consider your request for early termination and then ask for a court date when you can appear in court to ask the judge.

Will my son EVER be able to get a job with jail time on his record?

With a drinking offense, even if your son was 17 at the time, he would have still been charged with as an adult. It sounds like your son has made two very poor decisions in a very short period of time. There are many people who can get jobs, despite having spent time in jail; however, it can be difficult, especially in the present economy. If your son came to me, looking for a job, it would not so much be the jail time that I would be looking at, but rather the fact that your son appears not to have learned from his first poor decision. I would not want to hire someone who does not appear to learn from his mistakes, and continues to act without regard for the consequences. Your son is young. I suggest that he take a serious look at himself.

Without seeing the criminal complaint, it's hard to say whether or not his charges were filed as a felony. An excessive BAC can be charged as either a felony or a misdemeanor. However, if his public defender says it is a felony, then it probably was filed as a felony.
