Was he convicted for a DUI? Assuming he was (since you posted the question under the DUI law area, was a term of the probation that he not drink alcohol at all? Generally a term of probation for DUI is that you not drive if you have .01 BAC or higher? But usually it is not required to completely abstain from alcohol, although that could be possible. Double check the terms of the probation to see if having a few beers would violate it. If he has questions about the terms of his probation, check with the attorney who handled his case.

All DUIs are hard. .08 should get a reduced offer, if you want a dismissal it will be a tough fight probably involving trial.
