How will past criminal drunk driving charges impact my future?

Answered by attorney Jared Altman (Unclaimed Profile)
DUI/DWI lawyer at Law Office of Jared Altman
Yes. I think that your criminal history may affect your prospects. Your best bet is to try and turn a negative into a positive. A la "it was a youthful indiscretion and I have matured since then. Nothing like that ever happened or will ever happen again. I learned my lesson well. I'm burdened with this but it was a valuable lesson." Good Luck!

Is there retro-activity in medical marijuana?

Answered by attorney Patrick S. Fragel (Unclaimed Profile)
DUI/DWI lawyer at Patrick S. Fragel, Attorney at Law, P.C.
The medical marijuana card absolve you of criminal liability for the OWI (drugs), because you did not have a card at the time of the offense. However, the Prosecutor must prove that the THC visibly impaired your ability to operate the vehicle. The latest MI Supreme Court ruling held that the mere presence of THC in your blood does not constitute operating under the influence of drugs. That is the law that will apply if you are re-charged.

If I was arrested 3 hours away from where I live, can I get my DUI case transferred to my local court?

Thomas J Tomko

DUI/DWI lawyer at Thomas J. Tomko, Attorney at Law
Your case is proper where you were stopped by the police. Your defense will depend on a number of things, including the result of any blood test, and evaluation of the reason for the stop. You should hire an attorney to get the details of these and other aspects of your case.
