For a Public Intoxication charge the officer is not required to administer a Breathalyzer test. they may rely on their own observations to determine probable cause for arrest, such as stumbling, slurred speech, or other acts. Of course, those observations are subject to scrutiny in court, and especially a jury trial, where your lawyer can ask about the lack of Breathalyzer use, but it is only one fact to be considered. A judge must make a finding that their is sufficient probable cause to support an arrest. If the judge finds their was insufficient evidence to support probable cause the charges will probably be dismissed.

Generally, no one is required to provide anything, however, in an at-will employment relationship, you could be fired for failure to provide requested documents. At the same time, if you get fired, you could have a legal claim.
