If she was convicted, plead guilty, or took probation for a 2nd DWI prior to picking up the current charge in Texas, yes. Otherwise, no.

The answer depends on the disposition of the case.  If the DWI resulted in a conviction, the record cannot be sealed or expunged under Texas law and will show up during a background check.  If the DWI was dismissed, you should contact a lawyer to have the record expunged.  Good luck.  M. This is called the "rising blood alcohol defense". If you drank recent before the stop, your blood is still processing the alcohol. So at the time of driving, you were at an .06. But by the time they took you to have blood drawn, it rose. This is a defense, believe it or not. Get a lawyer to have it run for you. Don't do this on your own.
