Convicted of DWI (Class B), can I still carry a pistol in my car for protection?

Answered by attorney Laurie A. Schmidt
DUI/DWI lawyer at 5280 Law Group
Depends on the terms and conditions of your probation. If you are in doubt, check all of the paperwork and if the probation officer or courts told you that you cannot possess a firearm during probation, then you may not. If you are still unsure, check with your probation officer and if he/she says that you cannot, you can ask the court via a written motion to allow the continual possession of guns. I have seen probation officers in Colorado both allow and disallow firearms during probation. If the probation officer denies it, I have been successful asking the court for permission.

Can my son get his DUI dismissed since he didn't take the breath test?

No. Your son was arrested for a DUI. There is no way around it now. These are good jury trial arguments, but you must find a lawyer soon to represent your son.

Based on that it is possible, if the case is handled well, that the prosecution cannot use the blood test results at trial and possibly the DMV can't use them (so your license would not be revoked). One could argue that you have been precluded from having the results for your defense - and that could help.  However, the remaining evidence of the officers observations of you, etc. likely could still be used against you.  I am hoping you have hired a lawyer with lots of experience in DUI cases.
