If you have been charged with a DUI there is no statute of limitations for dismissing the case, a skilled DUI defense attorney may be able to bring other challenges based on specific case call and failure to diligently prosecute the case but, it requires that you meet the case law standards and that you appear in court. I assume that you failed to appear and a bench warrant was issued on the date you were supposed to appear in court.

He gets two charges DUI and driving on a suspended license. You have missed the real issue. What happens when he hits and injures/kills someone with a DUI and no license. That is when he goes to prison for twice the length of time as someone that has a license.

A VERY standard condition of probation is to not violate any laws while on probation. So, if you were arrested for driving on a suspended license or for driving without a license, which are both Misdemeanors, it almost certainly WOULD qualify as a probation violation if you were on probation for an unrelated charge when you got the "driving without a license" offense.
