Assuming that the DUI is the only offense, a fourth (or more) offense within 10 years is a "wobbler" and can be charged as either a misdemeanor or a felony, a second (or more) offense within 10 years of a prior conviction for felony DUI can also be charged as a felony. Another lawyer may have additional situations but these come directly to mind. Every county that my law firm serves will charge a fourth offense within 10 years as a felony, but you should check with a local attorney regarding the local prosecutor's policy.

First of all, don't agree to anything or plead to anything without consulting with an experienced DUI attorney first. Only a trained eye can carefully review the case file for any errors that could get the charge reduced or dismissed. A good DUI is immensely valuable and will more than pay for himself in what he can save you in terms of probation, jail, losing your vehicle, fines & costs, driver's responsibility fees, and higher insurance premiums. While case law isn't quite clear on just touching the center line yet, case law is clear that swerving within your lane is reasonable suspicion to pull you over. That is why you need a DUI attorney to review everything to make sure everything is done properly. The stakes are high even for a first offense conviction so don't go at it alone.

If you blew a .08% on the breath test (BT) you should definitely have your case reviewed for trial. You have very little to lose in MA by trying a case on a 1st offense OUI. The sentence on conviction is not far different than what we could negotiate for you through plea bargain. Therefore, if the case has a decent chance of success, you should NOT accept the plea offer until you are sure that you shouldn't take the case to trial. I don't think I can recall a .08% BT result that I did not take to trial and win. Understand that past results do not imply future success. Every case is different. However, with a .08% BT you were right on the line. In addition, you were NOT the driver. You have defenses for 2 of the 3 elements that the prosecution has to prove beyond a reasonable doubt. There is case law that says that the defendant's admission that he/she was the driver is not enough without other corroborating evidence to prove the element of Operation.
