Whether the officer had a good enough reason to pull your son's truck over would depend on what sort of facts the witness relayed to the officer. Tips from a witness must carry sufficient reliability before police officers can act on them. If the officer had only a suspicion or hunch that your son was drinking, then the stop would most likely not hold up in which case the evidence collected after the stop would be inadmissible. There are a number of other issues that need to be investigated in DUI matters beyond the initial stop of the vehicle. You should consult an experienced DUI attorney for a full review of your son's case.

Do you have an attorney? It is concerning that you have to ask such an important question over the internet. You deserve to have a lawyer that takes the time to discuss all of these important issues with you. If you are charged with a second and have a plea offer of a first, that is an okay deal. Why not an impaired? Is your driver's license through Michigan or another state? I highly suggest you talk to your attorney about these issues and if he or she is unable to answer your questions in a way that makes sense to you, it may be time to hire another lawyer.
