You're not necessarily screwed. Because it was a checkpoint, they won't have any bad driving to point to. Just admitting smoking won't be enough to convict. This one is definitely worth getting an attorney involved.

AFTER you have completed 6 months of screens, then you can talk about requesting a modification. You don't need to talk about a modification now, because you have NOT done six months.
