Depending on when he received his DUI, it should not matter, as long as the petition states that he was arrested and convicted of a crime. If you have not done so already, I strongly suggest that you contact an experienced immigration attorney for a face-to-face consultation and give him/her all of the facts surrounding your husband's arrest. He/she would then be in a better position to analyze your case and advise you of your options.
