What can I do if I was charged with the suspicion of a DU but I was not driving, I was outside the car and the key was in my pocket?

You think the police are stupid. The police arrested you, because you were drunk, the car was in a ditch, the key was in your pocket, and she was nowhere to be found. In this age of everyone carrying a cell phone, your sister went to look for help. Tell the judge that without your attorney.

How can I get a driver's license in California if I have a DUI case in Virginia?

California should honor the Virginia laws. I don't know when you plan to return to VA. If it is soon why don't you just take the classes there. In CA, if you will be here for a substantial time,,? you would have to apply at the DMV and you will probably have to go through an administrative hearing to get your license.

Do I have the chance to beat my case?

Cynthia Russell Henley

If the cops follow you into your driveway, it is not like the "safe" zone - you can still be arrested. Miranda rights apply only to custodial interrogations and if they questioned you while you were in custody, the only thing that happens is that any inculpatory (guilty) statements you made will be suppressed at trial. You need a lawyer.
