Can my son get his DUI dismissed since he didn't take the breath test?

Answered by attorney Philip Daniel Hache
DUI/DWI lawyer at Law Offices of Phil Hache
The citation and charges will not include the blown headlight as they have the DUI which is a much more serious charge, so they don't worry about the infraction on the charging document. If your son refused to do a breath or blood test, it is likely that they are also going to charge him with a refusal enhancement to increase the potential penalty. It can be helpful in defending the case if other officers pulled him over minutes earlier and let him go, but it is very unlikely that the charges will just get dismissed because of that, and as I mentioned earlier, refusing the breath test actually increases the potential penalties. He needs to have an experienced DUI attorney review and handle this case.

How much will a OWI attorney cost?

Hudson Thomas Bair
Answered by attorney Hudson Thomas Bair (Unclaimed Profile)
DUI/DWI lawyer at Kapsack & Bair, LLP
You should call DUI attorney's in your area, their prices are likely as varied as their services. You need to figure out what you want to do with your case, fight, see what can be done or plead guilty. You also need to figure out how important your Driver's license is to you, most Public Defenders are not aware of how what happens in court effects your license, beyond the DMV action. If you need to keep driving, you should hire a private attorney, even if they can't win your case, they will keep you driving longer and get you back on the road quicker.

What should I plead and what are the consequences for the plea for a first offense DUI of marijuana?

Answered by attorney Jason William Savela
DUI/DWI lawyer at The Savela Law Firm, P.C.
If you were not high at the time, you should not plea guilty - these cases can be won at trial the blood test is relatively meaningless for a heavy MMJ patient a plea of guilty to DUI will get your license suspended, but if it is a plea to DWAI-1st, then no.
